Unless otherwise stated in the product page, products - excluding Gift Baskets (Gift Baskets do not have a warranty) - have a 30 day warranty that begins on the date of purchase. Please refer to the Return Policy for details on return options during the warranty period.
The manufacturer reserves the right to provide the sole discretion on warranty coverage and availability as considered in a case by case basis. The warranty covers any defects in material or workmanship in all new products (as covered by this warranty).
Please note that this warranty does not cover any issues related to:
(a) misuse of the product, including commercial use, accidents, abuse, neglect, heat and humidity
(b) modification or any misuse contrary to the intended uses of the product
(c) damage caused by other equipment
(d) consequential damage, incidental damages or any costs related to construction, setup and assembly as incurred by 3rd party involvement.
(e) normal wear and tear
(f) damage arising from abnormal use, abuse or negligence
(g) products which have not been maintained, or which have been modified
(h) any indirect or consequential loss
(i) the natural characteristics of the product and leathers used within the product
(j) damage caused by spills such as acid, solvents, dyes or other corrosive materials, ink, paint, or human and animal bodily fluids
(k) improper cleaning, negligence, treatment of the product with chemicals, exposing the product to the sun, extreme heat or bright light such as lamps, or otherwise caused by your acts and/or omissions
(l) the cost of transporting the product to and/or from the specified place of repair or replacement.
(m) any accessories or add-ons e.g. Batteries, earphones, cables, carry bags, etc.
(n) applies only to the original product and is not extended for replacements.
Once it is determined that warranty service is required, you may be prompted for additional information or required to decide upon competing alternatives for resolution. Damaged or defective products returned must be properly packaged in the original packaging, or packaging provided to you and shipped with the pre-paid shipping label provided to you.
Warranty coverage will not be provided unless the claim is in compliance with all terms of this warranty statement, a copy of the original invoice is provided, and the proper return process and procedures are followed.
The manufacturers liability under this warranty is to repair or replace (at its discretion) any part or product covered by this warranty
This warranty applies only to the original purchase. Proof of purchase is required. To the extent committed by law, all other warranties, express or implied, are excluded. All goods subject to warranties must be returned in original packaging for inspection and assessment at your cost. The warranty is valid in Canada only, and is non-transferrable and is limited to the original purchaser specified in the original invoice at the original delivery address.
Warranty does not apply to commercial usage or shall be void should the original purchase change ownership.
To request warranty service, contact us at returns@gallerycanada.com. This notification must be made about warranty service and must be made within the warranty period. Any communication past the 30 day milestone mark is not covered by this warranty.
Please note that a warranty is not provided for Gift Baskets due to the nature of gift basket items. See Return Policy.
You are responsible for all costs and expenses which you incur or may incur in connection with claiming any warranty provided for under these Conditions of Sale and Warranty.
Except as set out in this Warranty and under the Canadian Consumer Law and subject to any condition, warranty or right granted or implied under any other law, which cannot by law be excluded by agreement, Gallery Canada will not be liable, whether in contract, in tort (including negligence), under any statute or otherwise, for any loss or damage of any kind suffered by you or any other person in connection with the goods including, but not limited to, indirect and consequential loss.
